I currently own a 1 bedder condo with another individual via tenancy in common arrangement. If one party is to buy over the share of the other party, what will be the procedures? Whats the estimated fee involved if we get a property agent to help with the administrative procedures or are we able to do it ourselves?

Hi,

This is considered sale & purchase of part-share. There will be legal fees of approximately $5k - $6k in total to engage 2 law firms. Also the staying owner needs to pay the relevant buyer stamp duties (BSD) to take over, while the outgoing owner may need to pay the relevant seller stamp duties. The staying owner also needs to refund the CPF + accrued interest utilized by the outgoing owner.

Hi,

1) The most important person you have to look for is a conveyance lawyer and not an agent.
2) If you need a loan from the bank in order to buy over the other party's share then you should look for a banker.
3) The banker will send a valuer to assess the value of the property so that you know how much you need.
4) There shall be 2 lawyers who separately process and buying and selling process.
5) The reason for 2 lawyers is to ensure there is no conflict of interest. Each lawyer will represent his/her client in their interest.
