I’m a condo owner and recently received a notice about a change to the estate’s house rules. One of the new rules affects when contractors can enter the unit and when renovation work can be carried out.
I understand that condo living comes with rules, but how much authority the MCST actually has to impose new restrictions on individual owners.

Hi,

1) The MCST is a body corporate created automatically by law under the Bgulding Maintenance and Strat Management Act (BMSMS). Every unit owner (Subsidiary Proprietor) automatically becomes a member of the MCST upon purchase.
2) The MCST holds significant authority to manage the development:
* Manage Common Property: It is responsible for controlling, maintaining, and repairing shared areas like pools, lifts, and gardens.

* Financial Authority: It determines and collects maintenance fees (Management Fund and Sinking Fund) and can pursue legal action against owners who default on payments.

* Enforce By-laws: It can enforce house rules and take legal action against owners who breach them.

* Contractual Power: As a corporate entity, it can enter contracts, hire Managing Agents (MAs) for day-to-day operations, and sue or be sued.

3) While all owners are members, the day-to-day decisions are made by an elected Management Council (up to 14 owners) during the Annual General Meeting (AGM). For larger developments, the council typically appoints a professional Managing Agent (MA) to handle operations.

If you are facing a specific issue (like a dispute over fees or by-laws), you can raise it at the AGM or escalate it to the Strata Titles Board (STB).

4) Therefore, this new requirement raised could be raised and implement according to the elected Management Council and not limited to only the MCST. They are the executing party than sole decision maker.
