Hi, if I purchase a new launch condo and it takes 3 years to be completed, does that mean that I would not have the pay seller stamp duty when I sell the condo immediately after completion since it has been 3 years from receiving the purchase agreement?

Hi,

As long as there is a 3 year period between the exercise date of your S&P agreement, and the exercise date of the OTP of your future buyer, seller stamp duty will not apply. This is also partly explains why new launches are selling well, as one can exit with some capital gains at TOP key collection.

Dear sir/madam,

As long as the date of exercising of the Option To Purchase for the buyer who purchased from you is 3 years or more from the date you have exercised the Sales & Purchase Agreement to purchase this apartment for purchases done on or after 11th March 2017, or 4 years or more should your purchase is done before 11th March 2017, you will not be subjected to Seller's Stamp Duty. It does not matter if the project has obtained its TOP or not, however, do give it a deep consideration due to the number of recent new launches, there can be a high number of resale units flooding the market when the time frame of 3 years is up as there are many investors out there looking to cash out too.

Yes, you're right. You will not be liable for SSD should you sell off your property after the 3 years holding period, from the day you exercises the S&P agreement with the Developer.

Yes you are right. If you sell the properties 3 years after the option exercise date, you are not liable for Seller Stamp Duties. In fact, one of my clients just exited upon TOP just last month with no SSD.
