Dear Mr.Ram Kumar, you have the rights to sue the seller, once the seller signs the OTP, they have to sell to you according to the terms & conditions stated in the OTP. Please consult your Lawyer for more details or please call me @ 91847685  .

Hi Mr Ram Kumar sir,

The HDB OTP is a legally binding document between the seller and buyer upon buyer exercising it. When the seller accepts the option fee on issuance of the OTP to the buyer, he already accepts to sell at the price agreed; and the buyer upon exercising the OTP while paying the option exercise fee, he also accepts the option.
Unless off the record if for whatever reason the buyer accepts the return of the full deposit from the seller, the buyer is deem to give up his rights buying that property.

I am not certain at what stage and situation you as a buyer are in. It is better to obtain legal advice in this case.
