What do you mean by decoupling? Is that to change the deed from two names (my wife and I) to only my name, doing that will free up my wife to buy another landed property? Two follow up questions. 1. How much legal fees will be incurred for decoupling? 2. I think SPR cannot rent out landed property. If I have one landed property and my wife buys a new landed property. We have to live in both properties and cannot rent out either one or both of them, right?

Dear Sir/Mdm,

Decoupling is a process when one party sell the share to the other party, effectively handing the ownership of the property to the staying party. This is done so as to free up the name to purchase a property without incurring Additional Buyer Stamp Duty. The legal fees is in the region of 6k to 7k.

Yes you are right, SPR are not allowed to rent out a landed property. If you intend to buy another property for investment, a condo will be a better option as you can easily rent it out with a higher yield and in the future, it will be much easier to sell as well.

Dear sir,

Decoupling takes place when owner A sells or transfers the existing shares of the property to owner B. Upon relinquishing the ownership of the property, owner A can then purchase another residential property without any Additional Buyer's Stamp Duty if there is no other residential property under the name.

For SPR cases owning landed property, you may wish to look into the permission to do decoupling as the original application to own the landed property is likely to have indicated the manner of holding for the intended purchase, therefore if there is any changes made, it is likely to require permission for it.

In addition, having granted the permission to own a landed property now does not automatically guarantee that permission will be granted to purchase the next landed property if existing landed property is sold, therefore in this case, it is best to do your due diligence before taking any actions.

You did not mention who is singaporean , who is p r , or both are p r .

I am assuming you are singaporean while your wife is p r .

The decoupling , buyer stamp Duty Plus lawyer fees to buy over your Wife share of the landed property will be less then 4% of the property value that your wife is holding , assuming your family landed is Valued at 4 million , and assuming the manner of holding was joint tenancy 50/50 ownership , meaning 4% multiply by 2m , you will be looking at paying approximately 80k for stamp duty / Lawyer fees.

After de coupling , Assuming your wife is p r , she Alone cannot buy landed property except for sentosa landed property , and p r also cannot rent out her landed property too , but your family can stay in the P R property as in your wife property , while renting out the singaporean / husband landed property .

Alternatively the p r buy a condo instead of a landed property then , Either or both properties can be rented Out .

Please note P R need to ABSD or extra 5% stamp duty when buying property , in addition to the standard BSD buyer stamp duty that all buyers pay .

Hi,

1) Decoupling is referring to changing the ownership from 2 to 1, usually only applicable to a married couple.
2) Yes, decoupling means a married couple can own 1 property each by themself.
3) Legal fees for decoupling usually range from $6.5k to $8k because there are 2 law firms needed in the legal process.
4) SPR cannot own a landed property by him/herself in the first place unless received an IPA from SLA LDAU.

Yes, you're right. Decoupling means to remove one owner's name out of the property. Legal fee for such is in the range of $6k+.

For SPRs to purchase landed properties, you will require LDAU's approval. You application would be assessed and decision would be on a case-by-case basis.
