We just passed the 1st yr of the 5 yr MOP for a 4rm HDB under my name, with my husband as an occupier. Due to my mothers health, we need to get a maid and therefore need a bigger place ( we have 2 grown kids). What is the likelihood that an appeal to purchase a private property by my husband’s will be approved?

Good evening,

Sorry to hear about your family situation. You should try appealing and obtain feedback directly from HDB. Do be mindful that all appeals are based on case by case basis especially you only fulfilled 20% of your 5 years MOP.

You probably can appeal to sell your existing 4RM and get a bigger HDB. If you sell your existing HDB within 3 years holding period, seller's stamp duty will be applicable.

Sorry to hear about the situation in your family. No one can advise on the probability as each case is considered by its own merits. Even if you have a precedent case being approved or rejected, your appeal results may not be the same. Whichever the case, as long as this is a genuine case of needs, do go ahead and put up your appeal. Do take note that in the event that your case is approved, should your property be sold in under 3 years from purchase, Seller's Stamp Duty can also be applicable, depending on when your property is being sold.

Hi,

1) I doubt you stand a chance to keep your HDB flat while buying a private residential property during the MOP.
2) The rationale of the HDB position is those who can afford a private residential property should give way to the less fortunate.
3) The HDB might approve your appeal to sell rather than keep and buy.
4) The SSD (Seller Stamp Duty) for the HDB only starts on the date of key collection. So you will be subject to an 8% SSD if you sell your HDB in the 2nd year of your MOP.
5) As of the current situation, the HDB still needs a lot of new flats for those queuing for BTO. So very likely the HDB will take back your BTO based on 90% of your purchase price.
6) So, you must be clear that you intend to sell in the open market rather than just stating you wish to sell.
7) You are to attach all relevant documents such as medical records, particulars of your mum, etc, so that the HDB can expedite your appeal.

Honestly, the appeal is likely to fail. If there's some possibility, HDB will likely ask you to surrender your flat, and "approve" you to purchase another bigger HDB flat. It is highly unlikely they will allow you to purchase a private property too.
