We have a corner 3 room HDB at Clementi, My wife suggested to buy the neighbor's 3 room HDB to form a Jumbo unit. But we already had a condo and HDB. The only way to buy it is to have divorce. I think it's not right to do so. My wife insists on having divorce and she said the marriage is the only obstacle to stop her from making more money. My question is during divorce process, can she buy the adjacent HDB immediately after obtaining IJ (interim judgement)?

Hi, I can hear that this is an incredibly difficult and painful situation for you, and I want to acknowledge that first. No property investment is worth more than a marriage — and it is completely understandable that you feel this way.
Let me answer your technical question honestly.
On purchasing HDB after Interim Judgement (IJ):
Technically after IJ is granted, parties are legally separated but not yet fully divorced — the Final Judgement (FJ) has not been issued. HDB's eligibility rules state that:

A person must be legally divorced with FJ granted before they can qualify as a single person to purchase an HDB flat
Under the Single Singapore Citizen scheme, the minimum age is 35 for singles buying HDB resale
During the IJ to FJ period, property purchases are also subject to court scrutiny as matrimonial assets may not yet be divided

So the direct answer is — no, she cannot immediately purchase the adjacent HDB unit right after IJ. She would need to wait for FJ and meet all HDB eligibility criteria at that point.
Additional complications to be aware of:

You currently own both a condo and an HDB — during divorce proceedings both are considered matrimonial assets subject to division
Any property purchase during the IJ to FJ period could be challenged in court as dissipation of matrimonial assets
ABSD implications will also apply depending on how asset division is structured

My honest advice:
This situation goes well beyond property — please consult a family lawyer immediately to protect your own interests throughout this process. A property agent can help with the real estate aspects but your legal rights in this situation need proper professional protection first.

Eligibility aside, the process to complete the settlement of divorce may mean that the neighbouring unit will be sold to others. Which owner will want to wait for uncertain situation when selling their property unless a significant premium is on the table.

Hi,

1) For a non-challenge divorce process will take around 6~9 months to complete.
2) You can apply for an HFE to buy over her share in the current HDB flat once the interim judgement is out. This shall shorten the whole process.
3) However, there are complication buying over since you still own a private condo.
4) You might be subject to ABSD of 20% on her share, although may apply for remission. Note that I use may, you should seek advice from IRAS in ba=lack and white to confirm.
5) You should calculate your finance properly to ensure that you won't face difficult buying over the shares.
6) You may complete the buying over once the final court order is out.
7) Note that if your spouse only wanted to have her CPF funds refund without profit, you may approach HDB branch office for a free transaction.
8) If she prefer to have the share sold in market rate, then, the whole process will take another 3 months to complete.
9) A standard process of submission of intent to sell, valuation, resale application, waiting for HDB approval, and final completion is expected.
10) So, all in all, the whole thing might takes up a 12~14 months period. You have to pray that your neighbour has not sold off his unit during this whole legal process.
11) Finally, to answer your question of whether she can buy the adjacent HDB immediately after obtaining IJ, the answer is yes if she doesn't need her CPF refund to complete the whole transaction.
12) Note that the period of receiving IJ to FJ could takes up to 3 months.
13) You may consult an experienced family lawyer to confirm on the timeline.
