Now my spouse and my children are staying in a rented condo. If I were to purchase my parents' resale HDB with spouse and children as essential occupiers. Are we still allowed to continue our condo lease agreement?

Dear Buyer,
Upon purchase of an HDB flat, you have to occupy it for a minimum period of 5 years. In your case, if you still want to keep the private condo you can but, it would be a waste of monies. Do contact me so that I can assist you further.

    Whether you can retain your HDB flat upon divorce, depends on the full judgement of the courts. To find out more, do contact me privately. Let us not discuss private matters openly.

    Thanks for reply. If I am sole owner of resale hdb and got divorce before MOP (5 Years) do I still get to retain the resale hdb and that my spouse who is essential occupier will be removed.

There's no restriction stopping you from buying over a resale HDB and renting a private property.

Just wondering why will you want to do so?
