My wife (Singapore citizen) and I (Singapore Permanent Resident) are currently separated and intend to proceed with a divorce. I am considering the purchase of a resale flat. Would I be eligible to purchase a resale flat jointly with my son, who is a Singapore citizen aged two?

If you have care and control of the child, yes you can purchase with your son after divorce and form a family nucleus to be eligible. Do you all own any other properties at the moment?

Hi,

1) Yes, you are eligible to buy with your child when having the full custody, care and control.
2) Otherwise, you will have to get a consent letter from your ex-spouse in order to be eligible to apply to buy a resale flat.
3) You may get the sample letter from the HDB.

Yes, as a Singapore PR, you can generally purchase a resale HDB flat jointly with your Singaporean child. In this arrangement:
• You would be listed as the owner.
• Your son would be listed as an occupier.

A few important points to note:
1. Eligibility – HDB allows PRs to purchase resale flats with their Singaporean children, provided the PR meets the other eligibility conditions (such as age and family nucleus requirements).
2. Divorce status – Since you are currently separated and intend to divorce, HDB will treat your child as part of your family nucleus for the purpose of the application.
3. Financing & grants – As a PR, you won’t be eligible for most HDB grants, but your child being a Singapore citizen does not affect financing for the flat.
4. Future spouse – Your current or future spouse will not be included in this purchase unless you choose to add them later and meet HDB conditions. Read More

As per HDB's guidelines, your (new) household must comprise 1 of the following groups if you intend to buy a flat.

A) You, your spouse and child(ren)

B) You, your parents and siblings. If you are an unmarried/ widowed/ divorced SC buying a flat with parents, at least one of your parents must be an SC or SPR.

C) You and your child(ren) under your legal custody, care and control (for widowed/ divorced persons). If the care and control of your child is shared with your ex-spouse, you must obtain his/ her written agreement before you may list your child in a flat application.

There are a few other factors and considerations such as your age, employment, how long you've been a PR etc that might come into play when buying a HDB.
