My sister and bro-in-law are living with me in a 4-room Hdb Flat. The house is co-owned by my sister and I.
My bro-in-law bought a condo with his siblings before marrying my sister.
My question is, can my sister and bro-in-law buy a HDB flat of their own? Better for them to move out.
What is the procedure for them to own their own flat?
Who needs to relinquish their ownership of which property etc?
Can I have sole-ownership of the current flat?

Hi Siti,

1) Yes, it is possible for your sister and brother-in-law to buy their HDB flat if they meet the eligibility scheme listed by the HDB flat.
2) But now it takes longer time for this to be possible due to the latest cooling measure implemented in Sep 2022.
3) Your bro-in-law has to wait for 15 months after selling his share in the condo before eligible to buy the HDB flat with your sister.
4) They will have to register an intent to buy on the HDB website: https://services2.hdb.gov.sg/webapp/BB31AWDashboardWeb/BB31PLogin.jsp
5) This application can last for 12 months. So they have ample time to look for their HDB flat.
6) You will have to fulfill 2 conditions to become the sole owner of the current flat:
(a) Meet the eligibility scheme listed by the HDB flat.
(b) Have the financial means to buy over your sister's share of the current flat.

As your brother in law is a private property owner, he will be required to wait out a period of 15 months after disposing off his share in the private property before he is eligible to purchase a resale HDB with your sister, where your sister will also be required to remove her name from this HDB, and in order for her to remove her name from this HDB, you must be eligible to own this HDB on your own, has the necessary capacity financially to service the loan of this HDB and be able to refund any CPF monies used by your sister for this flat including accrued interest.
