My husband and I stay in an HDB under which is only under my husbands name but which is under the married scheme. I am a foreigner who recently acquired PR status. Can I buy a condo in my own name before the MOP of the HDB flat is up?

Good morning Miss,

I believe you guys purchased existing HDB under non citizen spouse scheme with him as owner and you as essential occupier.

I am afraid to inform you that you have to fulfill 5 years MOP along with your hubby before you are eligible to purchase a private condo under your sole name. Do take that there will be ABSD applicable as SPR purchase.

Dear madam

The HDB was previously purchased under non-citizen spouse scheme, therefore regardless whether you are SPR or not, you will still be required to meet the 5 years MOP before you can purchase a condo in your own name as you are the essential occupier of the HDB. This is only for private residential properties (including those overseas) and does not apply if you are looking to invest in a commercial or industrial property.

Hi,

1) Although the current flat is bought under the Non-Citizen Spouse Scheme, you are only an essential occupier in the flat.
2) However, under the policy of the HDB, the essential occupier has to comply with the restrictions that an owner had, which is to fulfill the MOP.
3) Therefore you may only buy your residential property after the 5 yrs is met.
