My fiancée ls currently living with his mother as an essential occupier (only in their first year) for their new house.

We are planning to apply for Bto As the wait time is usually 4-5 years. Are we allowed to apply for BTO now? Or only after the 5 years MOP?

If your fiancé is the essential occupier, he will have to fulfill the 5-year MOP before he can apply for another BTO flat. If he's just an occupier, then no worries, he can apply with you anytime. Hence, you may wish to check if he's the essential occupier, or just an occupier.
