My father is filing for divorce and wants to sell the matrimonial home. Both my parents are in their 60s. The HDB (Maisonette) is fully paid for, and has met MOP since we have lived in it for over 30 years. May I ask if it is possible for me and my sibling to buy over my father's share in this divorce case? Both me and my sibling is over 35 years old, single and Singapore Citizens.

Hi,

I am sorry to hear about the unfortunate situation, hope you have been managing well. Generally speaking, if a married couple are joint owners of the matrimonial property, and the property is being contested as part of the separation proceedings, it is up to the courts to decide on the treatment after assessing the case and all parties have to wait for the court order. I presume the law firm your mum (or you) have appointed will be in a better position to advise given that they are privy to most details.

Good evening,

I would deem that the unit had been purchased by your parents under joint tenancy. So if you are only looking at buying over your father's share, it would not be viable as both must be willing to sell the unit for the sales to take place. You will also need to understand the content of the court order before proceeding with your intention.
