Me and my husband bought an EC together and already passed 5 years TOP. We decided to divorce and transfer ownership of the house to my husband. Can I buy resale hdb on my own since I’m past 35years old. Or do I need to include my children’s name in the hdb?

Is the final judgement out and transfer completed? Are you a Singapore Citizen? As you are past 35 years old and looking to purchase under your own name, you will need to be a Singapore Citizen, and will need to base on the divorce proceedings to apply for HFE in this case since you were previously a private property owner so you will be required to have a wait out period of 15 months before you are eligible to purchase a resale HDB based on existing regulations.

Hi,

Once the final judgement court order is out, you can as a single divorcee appeal to purchase resale HDB and try to get a waiver of the 15 month wait out period due to your special circumstances. Single divorcee 35 years and above is eligible to purchase resale HDB, the only concern for you is the 15 month wait out period after transferring your private property ownership.

1) You may process the part-share selling once the final court order is out.
2) You shall be eligible to purchase a resale HDB flat on your own once you observe the 15-month wait-out period after the completion of the part-share selling.
3) If you have the full custody and care of your children. You may include them in your application as occupiers.

Good day to you,

EC that has fulfilled MOP will become private property hence selling it means the need to wait for 15 months before you will be eligible to purchase your next HDB unit.
Filing for divorce will also take time, depending on the reason. It may range from 5 months to 4 or 5 years.
As for your last option, I would assume that your children have yet to reached the age of 35, hence without fulfilling above two requirements, it would be fruitless.

In order to purchase a resale HDB flat, you will need to serve a 15-month wait out period after transferring the ownership of the EC to your Husband.

You may wish to appeal to HDB for a waiver, if you have care and control of your children. Approval will be on a case-by-case basis.
