Ive sold a bto flat(under joint tenancy with my mum) previously and bought a resale flat(joint tenancy with mum too)…now that im married, after MOP, if i intend to buy a bto flat with my husband after selling the house, do i need to pay levy? For example the levy is 40K for 4 room bto. If i intend to buy another BTO flat with my husband (and my mum buying another BTO flat separately with her own husband) after selling the current resale house(joint tenancy me n mum), does it mean i have to pay 45k levy to apply for a new BTO and my mum need to pay 45k too for her BTO too? Or we pay half the levy each?

Also, understand that we need to wait 5 years before MOP before selling our joint tenancy house. In case whereby I happened to get married within this 5 years, i am not able to sell n get another house earlier until after MOP correct?

Depend on when the 1st subsidised flat was sold, the $45k is applicable and shared between you and your mum (50/50). Also, you will be considered as a 2nd timer for the next BTO application with your husband. Read More

Hi,

The resale levy also depends on when you sold the first BTO. If its after March 2006, yes resale levy is $40k for 4-room, and both you and your mum will pay $20k each.

Yes if you happen to get married within MOP period, you cannot purchase another HDB until after the 5 years has passed.

Hi,

1) You have to confirm when you sold your 1st BTO.
2) If you sold before 3rd March 2006, the resale levy amount will be based on a certain percentage of the resale price of the sold flat, or 90% of its market valuation whichever was higher. An interest at a prevailing rate of 5% per annum is chargeable.
3) If you sold on or after 3rd March 2006 then it will be at the rate you mentioned in your illustration.
4) If the BTO bought was a 5-rm BTO then the resale levy shall be $45k.
5) Since it is under joint tenancy (50/50) when you and your mum married and apply BTO separately, each of you will only need to pay the resale levy in half; $22.5k each.
6) You can pay your resale levy after selling your current flat in case you do not have this sum lying around.
7) But of course you will not be able to collect keys for your BTO without paying the resale levy.
8) You also cannot apply for a BTO before the current flat meets its MOP.
9) It is also correct that you are not allowed to sell your current flat or your share without meeting the MOP.
