If the HDB flat owners passed away without leaving any will, will the flat automatically go to the only child (who is above 35 years old)? What are the procedures involved to inherit the flat? What happens if this child just bought a resale flat (and thus have not reached MOP)?

Hope it helps. In the event that the beneficiary has an existing HDB which has yet to MOP, it is likely that the inherited flat needs to be disposed. You may check with HDB for final details too.

Hi,

1) Under the current Intestate Succession Act, the only child will inherit 100% of the HDB flat.
2) Since this is an Intestate succession means there is no will.
3) The Court will issue Letters of Administration and appoint an Administrator to distribute the property to his successors according to the Intestate Succession Act.
4) The duties of the Administrator are in Probate and Adminstration Act.
5) You may read more on the Probate and Administration Act here: https://sso.agc.gov.sg/Act/PAA1934.
6) I will strongly advise you to approach a lawyer to understand what you should do.
7) Under the current HDB policy, an entity can only own one HDB flat be it meets the MOP or not.
8) So under your situation, once you inherit the HDB flat legally. You will have to dispose of it within 6 months of possession.

By the way, yes you are right in a way but do check with the law firm who is handling this case for further advice. Also, HDB would likely ask the inheritor to sell away his parents flat simply because he has not hit the MOP of his own flat.
