I own a condo in my name only. My spouse is considering buying a resale HDB that would be in her name only. This HDB would be the only property in her name. Does she have to pay ABSD to buy the HDB?

Good afternoon Donald,

In order for your wife to be eligible under any HDB eligibility scheme to buy a resale HDB, your name has to be included in the purchase.

You have to dispose off your condo within 6 months from purchase completion date.

Care to share why your intention behind this move? Has she think of getting a private property instead so you dont have to sell your condo away.

As both of you are a married entity family nucleus, to purchase a resale HDB, your name has to be added into the application as well to form the family nucleus be eligible. You will have to dispose of the condo within 6 months.

If you wish to hold onto 2 properties, perhaps you guys can consider to purchase a condo in her sole name instead.

Hi Donald,

There is no ABSD when a buyer purchase a HDB. However since your wife is married to you, both of you will be considered as a single family nucleus under HDB. She may proceed to purchase the HDB but she will also need to include you name as either one of the owners or the essential occupier. In this way, you are required to sell your condo within 6 months from the purchase completion date.

She may want to consider buying a private property instead to avoid this issue.

In this case, ABSD would not be the concern. However as HDB would require one to include the spouse name as an occupier and an occupier could not owned a private property within 5 years MOP, HDB would require you to sell/dispose off your private property within 6 months from the date of your spouse purchase of the HDB.     Thanks. OK, so say I do sell my condo. Do you mean that after living in my wife's HDB for five years I could go out and buy a condo in my name only? Since I do not own the HDB, I don't pay ABSD on the condo, right? In the end, it is the same. I own a condo and she owns an HDB. Neither of us paid ABSD. By the way, I might be forced to sell my condo if it goes en bloc. Just trying to plan ahead. Advice appreciated.

If your spouse is a Singapore Citizen, she need not pay ABSD for her first property purchase.

Do take note that should she purchase a HDB flat, you will be required to be named as an essential occupier. This means that you will need to dispose off your interest in your condo latest within 6 months upon the HDB flat purchase.
