I don't own any property since 2019. Can I buy a 5 room hdb flat under sole name. And put my husband as essential occupier. He owns a private property. We know we have to get rid of private property within 6 months but I am checking if I can buy any hdb or do I also have to wait 15 months. I am less than 55 years old but my husband is 56 years old.

Hi,

Both your names have to be included in the hdb purchase. The wait out period of 15 months still apply, as both of you need to be 55 years old or older to be able to buy 4-room without any wait out period after selling.

Both of you are required to be aged 55 and above in this scenario and will only be eligible to purchase a 4 room resale HDB flat or smaller if you are looking to purchase immediately after disposing the private property. Otherwise, the standard of 15 months waiting period will still apply.

Hi Mdm,

For your case, you will need to wait out the 15 months period because you are under the age of 55 years old. I would advise for you to wait till you are 55 years old and you then can buy a 4 room or smaller HDB flat with your husband. If you wish to purchase a 5 room or bigger flat, you will need to observe a 15 months wait out period after the sale of your husband's private property.

As you both are married, therefore you will need to include your husband's name either as an owner or as an essential occupier. Therefore you will be subjected to the rules that I have explained earlier.

Hi,

1) After the new cooling measure implemented on 30th Sep 2022. A married couple who own (one or both) a private property has to observe a wait-out period of 15 months to buy a resale HDB flat.
2) The exception to the measure is for a married couple who are 55 years old and older buying a 4-rm flat and smaller do not need to observe the wait-out period.
3) The age requirement is applicable to both parties in the couple.
4) If you wish to buy a 5-rm flat, then you will still have to observe the 15-month wait-out period even when you reach 55 years old.
5) The wait-out period only starts counting on the completion date of the selling of your husband's private property.
