Hi HKGG,

You can eligible to purchase a BTO or resale HDB with your children if they are under your legal custody, care and control. If not, you wont not be eligible.

If you are buying a subsidised flat from HDB, you will have to pay the resale levy.

Subsidised flat means BTO direct from HDB or resale HDB with housing grant.

As per your statement, you are only eligible for HDB resale unit, if you have the custody of the children, under your care and control. For purchase of resale HDB unit, you are not required to pay levy of $40k.

For the purchase of BTO, you need to be SC as both your child are below the age of 21, even though they are SC.
