I am divorced in year 2013 and married (Non-SC) with Kid (SC). As per agreement with Ex-wife, I shall transfer the matrimonial flat (resale) 100% to her but due to the outstanding loan with Bank and she is not working, I can only clear all the loan by Apr 2017.

My questions:

1) Upon transferring the flat to my Ex. My name to be removed from HDB and I supposed I can buy a resale flat – Yes or No
2) Am I eligible for the grant? If I purchase resale flat? My earning is around 10k.
3) I am now working in Shanghai and next year will be back to Singapore and I have yet to apply visit pass for my wife. Can I buy under my name only or have to include her in the application?
4) To avoid renting a flat when I am transferring back to Singapore. How long it takes for the whole process? Buying a resale flat.
5) I am planning to get a flat either in Sembawang, Yishun (near Khatib), Sengkang or Punggol.

Under the current ruling, I would assume that you are paying for the mortgage on your ex-spouse unit via cash.
Being married with your current spouse, you can purchase resale HDB unit under non-citizen spouse scheme. You will not be eligible for both HDB loan nor housing grant as your income have exceeded S$6k.
The entire resale transaction from the point of OTP submission is around 4 months. Hence depending on your estimated date of return, we can always work on the timeline accordingly.
