I am buying a condo with tenancy until next year. When the condo is transferred to me, must I sign a new tenancy agreement with the current tenant. My gut feel is I should because now I am the new owner. Who can do this for me?
Do I have the right not to continue with the tenancy? How should I go about doing it, who can help me. Do I have to pay any compensation to the tenant?

Hi Ms Ng, you can choose to purchase the property - even with tenancy to purchase it with vacant possession. ie - it can be stated in the option to purchase that you wish to take over the unit - empty.

Then it will be for the previous owner to settle with the existing tenant.

If you have already completed this part of the transaction - then you would have to go ahead with the tenant continuing with the tenancy until it expires next year.

You do not need to continue with this tenant or be obligated to extend the tenancy with that tenant. However the tenant will need to sign a new tenancy agreement with you at the completion of the sale transaction for the unit. This will be handled by the lawyer. Hence you do not need to be too concerned about.

If you are buying a condo subject to tenancy, all you need to do is to get your lawyer to write to your tenant that you are the new landlord upon completion of sales and that future rent shall be paid to your bank account.
