My late husband (a foreigner) and I owned a private property in joint tenancy. The property has existing mortgage. My husband passed away few months ago. I would like to know the following. Thank you!
1. Will the title deed be updated to my name after I register my husband's death with SLA, although there's an existing mortgage for the property?
2. Can I only view the updated title deed digitally due to an existing mortgage?

Sorry to hear about your loss, I hope you are managing well. Did he prepare any Will prior? Is there any probate appointed? Any insurance that he has signed relating to the mortgage?

As its under joint tenancy, the ownership will be transferred to you, after the notice of death filed with SLA and the necessary paperwork procedures done through your estate lawyer. It is best to engage a law firm to manage the transition for the Estate matters.

Hi,

1) You are aleady aware that this is a legal issue.
2) You have to engage a family lawyer to assist in managing your situation.
3) If there is a Will from your late hubby, the lawyer will apply a Grant of Probate from the court.
4) If there is no Will, the lawyer will apply for a letter of Adminstration from the court.
5) The whole process will take 3~6 months.
6) The lawyer can also act on your behalf to apply for various authorities to ensure the property share to be under your name if you are the sole beneficial, otherwise, it will be distribute according to the Will or under the intestate succession act.
