Hi,Need some perspective on what i should be doing about my parents property mainly because i realise we never really or never talk about this properly or related matters. my parents are both in their 50s, still working and generally healthy . there HDB is jointly owned by both of them and me + my sibling are the only children my sibling is married and living overseas now, while am still in SG & no plan to move to anyother country i love SG.
The thing is my parents never really talked about what happens to the flat if one of them passes away . ialways assumed everything just goes to the other spouse first then to the children, but not sure if its actually that simple or process is different??.
They dont have a proper will as far as I know , and tbh I dont think any of us have thought much about it until recently . not trying to rush them or anything , but I also dont want everyone to suddenly panic and start settling paperwork when something happens .
Should we be doing anything now while both of them are still around ? Is making a will enough, or are there other things we should sort out specifically because the HDB is jointly owned ?
Just trying to understand what ppl normally do in this situation before i bring it up with them .

Because your parents own the flat under a **Joint Tenancy**, the process is straightforward while one spouse survives, but requires planning for what happens afterward.

### 1. What Happens If One Parent Passes Away?

* **The Right of Survivorship Takes Precedence:** Under joint tenancy, the flat does not form part of the deceased's estate. It **automatically transfers 100% to the surviving spouse**.
* Even if a parent writes a will leaving their share to you or your sibling, **joint tenancy overrides the will**.
* **Paperwork Required:** The surviving spouse simply lodges a *Notice of Death* with HDB/Singapore Land Authority (SLA) with the death certificate to register as the sole owner. No court probate is needed.

---

### 2. The Real Complication: When the Surviving Parent Passes Away

Once the surviving spouse becomes the sole owner, the flat enters their estate. At that stage:

* **If There Is No Will (Intestate Succession Act):** The flat will be split **50/50 between you and your sibling**.
* **Can You Keep the Flat?** HDB public housing eligibility rules apply:
* To take over the flat alone, a child must be a **Singapore Citizen aged 35 or older** (under the Single Singapore Citizen Scheme) and **cannot own another residential property** (or must dispose of it).
* If your sibling is married, living overseas, or owns private property overseas/locally, they may not be eligible to co-own an HDB flat.
* If neither child qualifies to retain the flat, HDB requires the flat to be **sold on the open market**, and the net cash proceeds will be divided between you two.

---

### 3. What Your Parents Should Do Now (While Healthy)

1. **CPF Nomination (Crucial):**
CPF monies **do not** pass via a will. Your parents should each log into CPF online via Singpass and submit their **CPF Nomination** to name their beneficiaries for their CPF balances and HDB CPF refunds.
2. **Draft a Simple Will:**
Once one parent passes away, the survivor becomes the sole owner. A will drafted now can specify whether the flat should be sold and proceeds split, or passed to a specific child if eligible.
3. **Lasting Power of Attorney (LPA):**
Equally critical for people in their 50s. An LPA empowers trusted proxies (e.g., the spouse or you) to manage banking and property decisions if someone loses mental capacity due to stroke or illness.

It is great that you are taking an early step towards planning this for your parents!

Without intentional planning, the assets (including the property) typically by default follows the interstate succession act, which you can read more at this government website:
https://sso.agc.gov.sg/Act/ISA1967?ProvIds=pr7-

In any case, there are a number of things that you can do in advance to prepare for worst case scenarios. Most families do this so that everything is properly planned for, instead of following the "default" situation which may not be what they want.

I'll be happy to walk you through what are some things you might want to consider and plan for early in advance.

In most cases, HDB is under joint tenancy. You may check with them at an appropriate time. Not everyone likes to talk about such matters especially asian chinese households.

In fact, I think it will be helpful if you are able to communicate with your sibling first on your concerns about these matters, not so much about how much you will get in future but rather how things can be handled.

At appropriate time, you may wish to speak to your parents about these or introduce a 3rd party to bring up this topic in order to trigger your parents to start planning.

I have been in the real estate business since 2009, with more than 15 years of experience serving the Singapore real estate market. Check out the EdgeProp featured article on myself recently at https://www.edgeprop.sg/property-news/geryl-lim-leading-landed-real-estate-heart-hustle-and-harmony

I am very active in the residential segment of Singapore real estate market, having transacted hundreds of deals from HDBs to private condominiums and landed properties in Singapore, and have handled many unique cases in sales and purchases as well as rental deals.

Over the years, I have also established a network reaching out to more than 15,900 expatriates, bringing my market presence to both in and outside of Singapore. This has created an additional exposure when I manage my client's portfolios, on top of the conventional on and offline platforms, where other estate agents are relying on. This has allowed me to consistently convert leads into results.

With an evolving market, where change is the only constant, I have also been investing in upgrading of my knowledge and skills sets to improve myself and meet the demands of current and future market.
