I own a HDB flat with my wife under joint tenancy . As my wife is younger than me, our flat is not eligible for Lease Buyback Scheme (LBS). However using my age, we're eligible for LBS.

Would it be possible to transfer the property's name to my name . Then apply for LBS?

Then to be fair to my wife, i could Will the property to my wife.

Could this work?

Hi,

1) The HDB has prohibit married couple to decoupling; i.e. selling shares to their spouse.
2) Therefore, your idea cannot work out.
3) I would suggest you to write to the HDB and approach for advices on what should you do with the current situation.

The Lease Buy Back scheme allows HDB owners aged 65 and older to sell back the remaining lease of at least 20 years to HDB, based on its current market value. Your intention to acquire your co-owner's share is relevant in cases such as divorce or death, hence currently not applicable. Please be aware that under the Lease Buy Back scheme, you will receive the funds only after fulfilling the CPF Minimum Sum. This plan don't work outrightly, therefore you may wish to see if HDB is able to bend the policy to allow you to do the transfer or allow for lease buyback.

Hi

HDB has disallowed transfer of ownership unless its due to financial hardship, divorce or demise of one owner. Since one of you is already at 65, you might want to write in to HDB to appeal about LBS application, they may exercise discretion based on your circumstances.

Do note once LBS is approved, the property is no longer to be considered under your legal ownership since it has been repurchased back by HDB, and thereafter you cannot legally "will" it to her. But according to HDB website, they may be able to exercise discretion to allow the spouse or child to continue staying in the flat, subject to eligibility conditions fulfilled.

I’m Aren Goh from PropNex. Transferring ownership just to qualify for the Lease Buyback Scheme can be complicated. HDB has strict rules around ownership changes, and there may be stamp duties and approval needed. Also, a Will doesn’t override HDB’s regulations on ownership and eligibility.
