Hi,

We're SPR(Malaysian), could kindly advice our queries?
1) currently we think to sold our 5-room hdb flat and buy a 4room hdb flat, we need to paid any hdb penalty if we down grade?
2) we also have own 2 properties at Malaysia now, what should we do?
3) if our properties at m'sia was full settled, can we just transfer the name to our kids also SPR here, without sold?

Hi there Kmser,

1. your 5 rm HDB flat, if you have completed your Minimum Occupation Period, you will not have any penalty.

Hence you can downgrade and buy a 4rm flat

2. As you own Malaysian properties, you cannot buy a HDB flat, yes you will need to transfer the HDB flat to your children. However the legal matters involving transfer directly, you best consult a lawyer from Malaysia regarding if you can do this at as low a cost as possible. Of course your children must be of legal age to be able to own the property.

your third question is related to question 2. You best ask a lawyer on the transferring of title ownership to your children.

Afternoon,

Being SPR, you are only eligible to purchase resale HDB unit, without grant. Hence you will not be liable for any liability upon downgrading.

As for your properties in Malaysia, you can transfer the ownership to your children before you start the marketing of your unit. Do take note that if you transfer your Malaysia property to your children and if they do intend to purchase resale HDB units in the future, they are then required to remove their names from the private properties too.

Hi Kmser,

1) You need not pay any levy if you downgrade.

2) After buying your 4 room flat, HDB will give u six months to dispose off your property at Malaysia.

3) Yes, you can transfer the property to your children's name. However if they would to purchase a HDB flat in future, then they would need to dispose it off as well.
