Hi Sir,

If a buyer has exercise the HDB OTP by putting $1k Option fee and $4k as exercise option fee and later found out that she has legal limitation to proceed with the OTP due to her divorcing case... can she request a full refund base on this ground?

I empathise with you in this situation, and understand your issue relating to a case where the buyer is finding a reason to invalidate the OTP. You mentioned about the buyer's problem of her divorce matter but did not elaborate, I could best make some assumptions then. Maybe she has not got her absolute decree nisi selling her flat before buying yours? or...
Was she represented by her buying agent at the point of OTP exercising, and if you are also represented by your selling agent? The buying agent would/ should have checked and verified the eligibility of the buyer. Prior to the signing of the OTP by the buyer and at the time of placing the option exercise fee, the seller agent could have asked for documentation verification.

When OTP is accepted by both the seller and the buyer, it is legally binded actually. The case may be 'made' more complexed if the seller is unwilling to let go the case due to his accepted C.O.V. and thinks a 2nd buyer may not offer the same. Have made some assumptions before and barring no other unknown circumstances, the buyer is deemed to fail in her obligation as a buyer of your unit. In such a case, the seller is at his advantage/ discretion to proceed with the sale.
