Dear all experts,

My Multi generation HDB has hit the 3.5 years MOP mark.

Due to unforeseen circumstances, my wife and my parents had a heated argument and couldnt get along in the process.

My eldest daughter will be enrolling her primary school next year and it will cause her detrimental issues if we move after that if she has gotten in her school that we desire.

We tried means and ways (ie going to MP, writing to them and writing to HDB) but to no avail.

My wife and I are also planning to have a 3rd kid and we cant stay on this house for long.

May I check whether any agents are confident to help to appeal and sell the house pls?

I will truly appreciate and thank you for that.

**No property agent in Singapore has the legal authority or special access to bypass HDB’s system and sell your flat before the 5-year Minimum Occupation Period (MOP) is met.** Anyone claiming they can "guarantee" an early waiver is misleading you.

Until HDB grants official written approval, an *Intent to Sell* cannot be registered on the HDB portal, making it legally impossible for any licensed agent to market your unit.

---

### Why HDB Rejects These Appeals

Under HDB policy, early open-market sales are granted almost exclusively for structural legal or financial crises: legal divorce, bankruptcy, or death/terminal illness of a core applicant.

* **In-Law Disputes:** HDB considers family friction a domestic matter rather than grounds to waive statutory housing covenants.
* **3Gen Flat Rules:** A 3Gen flat is subsidised specifically for multi-generational co-residence. Parents are registered core applicants and cannot be removed during the MOP.
* **P1 Registration:** MOE distance priority is not recognized by HDB as a valid ground to breach MOP.

---

### Practical Options Moving Forward

1. **Move Out and Rent a Nearby Home (Recommended):**
* You, your wife, and children can lease an apartment nearby to defuse family tension immediately while your parents anchor the 3Gen flat.
* **MOE 30-Month Rule:** If you use your 3Gen address to secure priority admission within 1km/2km, MOE mandates that the registering parent and child reside at that registered address for at least **30 months from the start of the P1 exercise**. A premature address change risks having the child transferred out by MOE.

2. **Wait Out the Remaining 18 Months:**
* At 3.5 years, you have only ~1.5 years left. Selling post-MOP ensures you capture full open-market value (note: 3Gen flats must be sold to another eligible multi-gen family).

3. **Surrendering to HDB (Avoid if Possible):**
* Handing the flat back to HDB yields only HDB’s assessed compensation price (far below open-market value), leaving minimal cash after mortgage and CPF accrued interest refunds.
