Hi, seeking your professional advices. If a married couple bought a hdb flat but under sole ownership, Husband as sole owner and Wife as Spouse Occupier. Can the wife subsequently buy a private property as sole owner without ABSD while being a spouse occupier?

Good morning h,

If the household has a Singaporean and with such arrangement, hubby as owner while wife as essential occupier, wife is able to buy a private property without ABSD (assuming SC) after fulfilling 5 years MOP along with hubby.

Yes, this is possible, provided the Wife is a Singapore Citizen.

Also, do note that both owner and essential occupier must fulfill the 5-year MOP before being able to purchase another residential property.

Yes if you are an essential occupier and have fulfilled the MOP of 5 years, you can purchase the next condo without ABSD once the MOP of 5 years of the HDB is met.

1) Yes, this is possible.
2) Although the wife is the essential occupier by default if they had bought the HDB flat after they got married.
3) But the wife can only buy the private property after fully observing the MOP of the current flat.
