Hi, my wife and I plan to sell our HDB and buy a resale HDB for living and a condo for investment. We are <35 y/o. How do we do this? Can my wife buy the resale by herself and list our toddler as an essential occupier, or must she wait till 35 y/o?

Hi

Unfortunately you cannot purchase the next resale hdb with just your wife sole name + kid, as you need to form the family nucleus required by hdb and both you and your spouse names have to be included. This means a fresh 5 year MOP again before you can purchase the private property.

Alternatively you can go for 2 individual private properties. Or 1 hdb (under owner occupier arrangement), wait out 5 year MOP, then purchase the private property under occupiers name so that this way you can own 1 hdb and 1 private individually (still feasible based on current regulations). Of course the final way is to just pay the 20% ABSD to buy the private property if you intend to keep the current hdb.

As husband and wife, both names must be in the HDB unit, even if only 1 of you is the owner, the other party will need to be an essential occupier and therefore a fresh 5 years MOP will be applicable on the resale HDB.

In such event, I believe it will be more beneficial to look into purchasing a private residential immediately instead of losing out time on loan tenure with a fresh 5 years MOP for the resale HDB where possible.

Since both of you are under 35, your wife can’t buy a resale HDB alone with your toddler unless she qualifies under special schemes (like the Divorced/Widowed Parent with Child Scheme). For now, you’ll still need to buy as a couple under one of the family eligibility schemes.

If the goal is to hold both a resale HDB and a condo, the sequence matters — you must dispose of your existing HDB before buying private property, unless the private unit is bought after fulfilling MOP and the HDB is then sold within six months.

The smoother way is often:
1. Sell the current HDB first.
2. Buy the resale HDB under one name (once eligible).
3. The other spouse buys the condo separately under their name for investment. Read More

Hi,

1) When you intend to hold on to an HDB flat whether it is a BTO or resale. One of you must be the owner and the other to be an occupier (auto to be a core occupier under married status).
2) You have to buy an HDB first and observe the 5 yrs MOP before the occupier is allowed to buy a private residential property.
3) You must be the core occupier as long as you are under married status. And you are only allowed to buy any private residential property after meeting the 5 yrs MOP.
4) You are still at a young age at 40 to invest in private property.
5) There will be good property to invest even after 5 yrs.

In HDB’s eyes, a married couple is treated as one family unit. This means your wife cannot buy an HDB flat on her own with your child without including your name.

If your goal is to buy an HDB for own stay and a condo for investment after selling your current HDB, here’s how you can structure it:

Purchase the new HDB under both your names, but list your wife as the owner and yourself as the occupier.

Both of you will still need to fulfil the 5-year Minimum Occupation Period (MOP).

After the MOP, your name (as the occupier) can be freed up to buy a private property without incurring ABSD, since it will be considered your first property.

Note: Only your wife’s income and CPF can be used for the HDB purchase, while only your income and CPF can be used for the private property later.

If you wish to own both properties without waiting for the 5-year MOP, the alternative is for each of you to purchase a separate private property under individual names instead of buying another HDB. Read More
