Hi my parent are getting a divorce,the HDB is fully paid and my dad agree for my mum to buy over his portion. However my mum is a housewife ,so can I be a guarantor for her home loan and how does it works? My dad portion is around 400k ,so if I take a loan do the bank pay him in cash or bank transfer?

Dear sir/mdm,

Am sorry to hear about the situation, nevertheless, the split or management of the matrimonial aspect is not as straightforward as what your parents intend to do. It has to go through the court and with a final judgement, both your parents can then proceed on the arrangements.

Given that your mum does not have any income, if she does not also have any CPF funds in the CPF accounts, there is no way she can take over the property as there is no arrangement in place for guarantor system for Singapore's real estate market now. A borrower has to be at least a co-owner of the property.

Unless you are able to get a personal loan to cover the amount required to buy over, then it is possible. Otherwise, am afraid to say that there could be alternative arrangements required to take over this property.

Sorry to hear about the situation, I hope you are managing well.

If you wish to be a guarantor or to take a bank loan on this property, you have to be the owner of the property as well. If not you can't do that.

For divorce cases they also have to go through the court proceedings and file for the court order. Only when final judgement court order can they proceed to do what they need for the property ownership. Has your mum spoken to a lawyer on these matters?
