Hi, my mum is a single PR (more than 35 years old) and I am a SC (more than 21 years old). Can my mum buy a HDB resale on her own without listing me as an occupant? If not and she lists me as an occupant in the HDB resale, will I be binded by the MOP of the HDB resale? Can I still buy private property under my name without incurring ABSD? Thank you

You will need to be minimally an essential occupier in this case. Should your mum remain as a SPR in future and you are looking to purchase another HDB, this property will have to be sold as your mum is ineligible to own a HDB as a single SPR.

You will be binded by the MOP of the HDB as an essential occupier too, thus you will only be able to purchase a private residential property after fulfilling the MOP. The good news is that you will not be subjected to any ABSD since you do not own any residential property.

Of course, this is based on existing regulations, which can be updated anytime by the authorities basing on the market sentiments. As you maybe aware, there were several rounds of measures introduced over the past couple of years and as a result, priced out many potential buyers from the market or these potential buyers may have to settle for something smaller or less pricey due to the introduction of measures.

As your Mother is a single SPR, she will need to include you in her HDB purchase, either as a co-owner or an essential occupier. This means that you will need to serve the MOP before you can purchase another property. You will not incur ABSD when you purchase a private property in the future if you do not own the HDB flat.

Hi,

As she is a single SPR, she needs to add your name as essential occupier to be eligible to purchase resale HDB. This means both of you will need to serve a 5 year MOP period before you are eligible to purchase another residential property. When the 5 year MOP is fulfilled, you as the occupier can go ahead to buy your private property without ABSD, based on prevailing regulations.

My Answer with regards to your Question:

Single PRs cannot buy a new HDB flat or a resale flat alone. Under HDB rules, a PR may qualify to buy an HDB flat under two schemes: the HDB Public Scheme, which is buying with a family unit (i.e. spouse, children, siblings, parents), or the Fiancé/Fiancée Scheme, which is well, your fiancé or fiancée.

in the HDB resale, you would indeed be considered an essential occupier. In such a case, you would be bound by the Minimum Occupation Period (MOP) of the HDB resale property, even if you are a Singapore Citizen (SC).

After fulfilling the MOP, you can purchase a private residential property under your name without incurring Additional Buyer's Stamp Duty (ABSD), provided you do not own any other residential property at the time of purchase.
