Hi,

My husband owns a private property under his name. Can I purchase a resale HDB under my name? Or would my husband be forced to sell the private property and we have to wait 15 months even if the resale HDB is only under my name?

Good morning,

Your husband needs to be included as an owner or essential occupier in resale HDB purchase as a married couple is considered a family nucleus.

In order to proceed, he has to dispose off his private property and observe 15 months waiting period first before applying for HFE.

Unless both of you are 55 years old and above, 15 months waiting period wont be applicable. You can purchase up to a 4RM flat after disposal of private property.

Hi, as both of you are married, you are considered to be in a family nucleus and both of your names will have to be included in the HDB as either owner or essential occupier.

As much, the private property will have to be disposed of being able to purchase a HDB with a waiting period induced.

Hi Mdm,

As you're married, your Husband will have to be named as either the co-owner or the essential occupier of the HDB flat you're purchasing.

If either of both of you and your Husband are below the age of 55, you will not be eligible to purchase a resale HDB flat until he sold off his private property and wait out a 15-month period.

If both of you are above age 55, then you're eligible to purchase a HDB resale flat up to 4RM flat in size. He will be required to dispose off his interest in his private property latest within 6 months of your HDB flat purchase.

For your case, you will not be allowed to purchase a resale HDB because since you are married, you will need to include your husband either as an owner or an essential occupier during the purchase. In this case, he is not eligible because he owns a private property.

In order to be eligible, he will need to sell the private property and wait out a 15 months period before you both are eligible. However, if both of you are above the age of 55 years old, this 15 months waiting period will not apply but your husband will need to sell off the private property within 6 months from the purchase of the HDB.
