Hi, my 2 year rental contract for a condo unit includes a diplomatic clause that can be exercised at 12 months giving 2 months notice. Can I give notice at 10 months and terminate the lease at 12 months completion? The diplomatic clause does not specifically mention when the notice to terminate can be given. Does it have to be after completion of 12 months or can be given after 10 months completion? Thanks

Hi, that clause means that you can only exercised upon a minimum stay of 12 months, not on the 11 months or the 10.

Afternoon,

Aspen your statement, the TA is 12 + 12, with 2 months notice. Should you provide notice at 10th months, you had not fulfilled the minimum requirement indicated. Your landlord does have their legal rights for claim. I would deem that your servicing agent would be your best person to assist you accordingly.

As not to sour the relation further with your landlord, I might recommend to look for tenants to take over your lease. Try Advertising yourself in Gumtree, Carousell or even classified ads. Or you can engage agents to help you. You may only exercise the dip clause after 12 months and leave on the 14 month. Read More
