This is very common in Singapore, especially for expatriate professionals whose employers provide housing packages. However, you need to set up the legal structure properly to avoid payment disputes.
You have two ways to execute this:
---
### Option 1: Personal Lease with Third-Party Payor (Simplest)
The Tenancy Agreement (TA) remains strictly between **you and the individual tenant**. The tenant remains 100% legally liable for rent, damages, and lease covenants.
**What you must do:**
1. **Third-Party Payment Clause:** Add a specific clause in the TA:
> *"The Landlord acknowledges and agrees that monthly rental payments may be remitted directly by the Tenant’s employer, [Company Name & UEN], on the Tenant’s behalf. Such third-party remittance shall satisfy the Tenant’s rent obligation, provided that the Tenant remains personally and primarily liable for all obligations, liabilities, and default under this Agreement."*
2. **Security Deposit Handling:** Specify clearly in the TA whether the security deposit refund upon lease expiry is returned to the company account or the tenant's personal account.
3. **Verify the Company:** Run a quick ACRA check to ensure the company is an active Singapore-registered entity.
---
### Option 2: Full Corporate Lease
The company signs the TA as the official Tenant, and the individual is listed solely as the **Permitted Occupier**.
* **Pros:** Established MNCs rarely default on rent and pay promptly via corporate finance.
* **Watch-Outs:**
* **Signatory Authority:** You must verify that the person signing has corporate authority (Director via ACRA BizFile or a formal Board Resolution / Letter of Authorization).
* **Occupier Substitution:** Companies often insert a clause allowing them to swap the occupant if the employee resigns. Ensure you retain veto rights on sub-tenants to comply with URA occupancy caps.
---
### Key Things to Check Before Signing
* **URA Minimum Stay & Cap:** Ensure the condo lease is at least **3 consecutive months**, with total occupants within URA guidelines (max 6 unrelated persons).
* **Work Pass Validity:** If the occupant is on an Employment Pass (EP), verify their digital pass via MOM's SGWorkPass portal. If doing a 2-year lease, ensure their diplomatic clause requires 12 months minimum stay plus 2 months' notice.
* **No GST on Residential Rent:** Residential leases in Singapore are exempt from GST, regardless of whether a company pays the rent.
* **e-Stamping:** Ensure the TA is e-stamped on IRAS within 14 days of signing.
