Hi. Me and my wife are in the midst of divorcing each other.
We are married for more than 3 years, currently staying in a 3 room resale flat (MOP in 2022), have 2 children aged 2 and 4 years old; lastly have fully paid off our housing loan.
We have some questions for clarifications with regards to our divorce.

1. If my wife has legal custody to the 2 children, who has the right to own the house.

2. Are we able to sell the house in open market before it MOP.

3. Assuming we sold the house before it MOP, is my wife with legal custody to the 2 children able to purchase a new BTO regardless of room size.

4. If the above is true, is there any income ceiling cap to it.

Dear Sir,

Sorry to hear about your situation.

1) If your wife has the legal custody of the children, she will be able to retain the flat.

2) Yes it is possible to sell the place in the open market but you will have to appeal for special permission to sell before the MOP.

3) Yes you wife will be able to purchase a BTO as well subjected to HDB approval.

4) The income ceiling for subsidised flat is 6k for single.

Please refer below to the answer for your query.

1) If you have custody (care and control) of your child, you can retain the flat if eligibility conditions are met.

2) If you wish to sell your flat in the open market, you must have satisfied the MOP by the divorce completion date. If the MOP has not been satisfied but neither party is eligible to retain the flat, HDB will assess if it can be returned to us, and determine the compensation amount for the flat.

3) HDB have set aside 2- and 3-room flats in non-mature estates for divorced/ widowed parents with children below age 16 in Build-to-Order (BTO) exercises. Divorced persons are also able to buy or own a subsidised flat each upon divorce, from 6 March 2018.

Hi,

It's a regret to hear about your situation.

1) If you are of age 35 yrs old and above. You also entitled to keep the flat yourselves. But all-in-all, if this is left as a dispute, and your wife is able to receive loan or has suffcient fund to keep the flat.
The judge will usually let your wife take the flat if she wanted to.

2) Yes, you are allowed to sell the flat in open market even though it has not met MOP. You have to write in to appeal to HDB to allow you to do so after receive your final judgement.

3) Yes, through the Assistance Scheme for Second-Timers (ASSIST), HDB set aside 2- and 3-room flats in non-mature estates for divorced/ widowed parents with children below age 16 in Build-to-Order (BTO) exercises. Divorced persons are also able to buy or own a subsidised flat each upon divorce, from 6 March 2018.

4) Income ceiling cap remains the same as any application, single is $6k.
