hi,

I'm under 35 and currently currently owning a Flat together with my mum under the joint tenancy scheme.

Given my age is my mum able to change her role to occupier instead of co-owner? if this is possible then if she were to buy a private property will she be subject to the additional 7% stamp duty?

Hi Mr. Leslie,

Firstly, you will have to fulfil your MOP of 5 years. For her to change from owner to occupier, you have to apply with HDB and approval is up to their discretion, depending on your reasons for doing so and on case-by-case basis. At the minimum, the family nucleus for the HDB must still be maintained. Thanks and may I understand some details further over email before advising further?

Just to add onto Ivan's answer to you, please note that if your mother's name is to be withdrawn as co-owner and be changed to essential occupier, you would have to refund the CPF portion (plus accured interest) that she used to pay for this current HDB flat.

Hi Leslie,

Yes, indeed it is subjected to HDB approval. Should your mum be withdrawn as a co-owner, she will have to remain as an essential occupier. The whole process will take about 3 months and a small administrative fee is required.
As mentioned by Robbie, CPF + Accrued Interest used from your mum's account must be returned.
Another important point is whether there is still any outstanding loan for the HDB? If so, there are more things that you have to take note of.
