Hi, I'm married and I do not have any property under my name. My husband has one private property under his name. Can I use my name to buy a new launch EC with one of my children (29 year old)?

No, your husband's name has to be together with you, even if applying as essential occupier. The fact that he is a private property owner disqualifies you to purchase the brand new EC.

As my colleagues mentioned, it will be challenging for you to do so.

I guess the underlying question is why you want to buy a new launch EC? Unless there is one specific project that you are extremely in love with, there are comparable & better options (both among new launch and resale condos) you can consider whether it is for own-stay or investment. These will not have any of the government restrictions in place to prevent you from buying.

Unfortunately no, new EC purchase from developer requires fulfillment of HDB eligibility conditions. And one such condition is to fulfill a family nucleus to be eligible to apply, which requires both you and your husband to be included in the application. As he currently owns private property, he cannot apply for new EC unless the private property has been sold for 30 months.

You may wish to consider resale EC or other undervalued private property purchase under your sole name for investment.

Hi,

1) A new EC is still under the HDB jurisdiction since it is property heavily subsidized by the government.
2) Therefore, it has to follow all the eligibility and income ceiling restrictions, etc.
3) A married couple is considered a single entity. It means that both names must be together to buy and sell.
4) Since you are still married, you cannot buy a new EC without your husband's name.
5) Even though, you and your child formed a family nucleus under the HDB definition.

Unfortunately, new launch Executive Condominiums (ECs) follow HDB regulations. Under these rules, you and your husband are considered a single entity. As a result, if you wish to purchase a new launch EC, your husband's name must be included in the application.

However, since he already owns a private property, you're not eligible to purchase a new launch EC.

That said, you can still consider other options such as a resale EC or a private property (either new launch or resale).
