Hi, I'm a SC holding onto a pte condo for 3 years, sole owner. My new spouse is SPR. We intend to get a bigger house together while I wish to keep my own pte condo. How is ABSD payable? Can my spouse buy on her own name while I be her guarantor, will we pay lesser ABSD?

Hi,

ABSD depends on who the purchasers are, and is taxed on the higher tax bracket of all purchasers.

ie. If your spouse purchases as a sole SPR purchaser, 5% ABSD is payable.
If you jointly purchase, ABSD is 7% since its your 2nd residential, and her 1st property.

If you choose to be the guarantor, your name needs to be included in the purchase, hence it is still 7% ABSD. It is likely you need to put in your name as a joint-purchase to qualify for a higher loan quantum possible, since its a bigger property you are considering.

If your spouse purchases solely under Her name, the ABSD liable would be 5%, however the rates will differ should you include your name as well. This is rather subjective - considering the loan quantum given the larger property you are looking at.

I will advise her to purchase solely under her name, in this way ABSD will be lesser but this can only be done if she's financially capable to finance mortgage by herself as you can't be guarantor nowadays.

If it's a joint purchase, ABSD will be 7% as this will be your second residential property purchase.
