Hi. I would like to purchase a resale flat with my mum joint-name as a family nucleus, but she is currently in a divorce process (to be finalized next month).

Can we actually start registering Intent to Buy on HDB portal, followed by engaging an estate agent to view resale flats now? Or must the divorce procedure be finalized first before we start registering Intent to Buy on HDB website and find an agent?

Good afternoon Sir/ Mdm,

You wont be able to register intent to sell with your mum as long as she is not divorced yet.

When in next month will she receive the final judgement or court order?

But nevertheless you can start checking out units first. Do take note nowadays resale flats are being snatched up pretty fast so there might be a high chance that you like but cant compete.

You can only register the Intent to Buy after the divorce proceedings are complete, as her official status is not confirmed until final judgement court order is complete.

However its still possible to start shortlisting units to view first. We can also do some initial calculations to see your available options.

1) Right now because the final court order is not available yet. When your mum registers her intent to buy now she will need to include your dad in the application.
2) Thus you are unable to start this process.
3) However this does not affect your shortlisting of the location and types of flat you intend to purchase.
4) You may apply for a loan from the HDB or to get an IPA from the bank. So that you can ascertain your budget for this purchase.
5) Do note that if you are applying for an HDB loan, you must not offer an OTP in your viewing process.
6) It is essential to have a valid HLE when you offer an OTP.
