Hi I took grant of $30k because of bringing along my mother in law. Now my MIL decide to move out from the flat, my flat just 3yrs old. If she move out do I need to pay back the grant to hdb? If need to pay, able to pay via cpf or cash?

Your mother in law is required to stay until MOP minimum. You may wish to speak to her about this. As for what the consequences are if she moves out prior to MOP, you may wish to check with HDB. Read More

Your mother-in-law is required to stay in the property for the entire Minimum Occupation Period (MOP). It might be good to have a conversation with her about this. If she plans to move out before the MOP ends, I recommend checking with HDB to clarify any potential penalties or issues that may arise.

Hi,

1) If the situation cannot be recovered and she insist on moving out, she must get an approval from the HDB to start with.
2) Because the PHG condition is a rule and regulation, and the HDB as an authority has the right to punish the person who violate the rule.
3) The penalty listed under the web were:
(a) Not register or stop processing application to buy any resale flat.
(b) Compulsorily acquire the resale flat,
(c) Recover the PHG grant with interest.

4) The penalties do not limit to only any one of the above, all penalties can be imposed on the person who violate the rule.
5) Therefore, your MIL might has to buy a private residential premise instead of HDB flat.
6) You have to return the PHG grant with interest.
7) There are 2 scenarios could happened under your situation:
(a) Your MIL bought a residential premise within 4km, this means you could only need to return $10k + accrued interest.
(b) Your MIL bought outside of this 4km radius, you will have to return the $30k + accrued interest.

8) The last is whether able to retun via CPF or cash. If you have sufficient funds under your CPF OA, you may return using the CPF fund only.
9) If you do not have sufficient fund in your CPF OA, then has to return or top-up with cash.
