Hi, I'm a Singapore Citizen, going to get married with a foreigner with a foreign property. I would like to know whether the fact that my future spouse currently owns a foreign property will prevent me from owning certain type of properties in Singapore. From my understanding, it's only a problem if we want to buy an HDB? What about buying a condo instead?

Hi! Congratulations on your upcoming wedding! Am very familiar with this and have handled multiple cases.

Largely speaking policy wise it is only an issue if you wish to buy a HDB or Executive Condo. No issue if you wish to buy other types of property in Singapore, but you need to take note of some other aspects such as financing that might be affected.

Congrats on your new milestone! Yes he will have to remove legal ownership from his foreign property, should you guys decide to go for HDB. In fact there is a wait out period after disposing his interest from his overseas property before you can purchase HDB as a family entity.

For condo or private property, no such issues. He can keep his foreign property.

Congrats on your upcoming marriage. As your spouse has a foreign residential property, you will not be eligible to buy a HDB flat. As for private properties like condos, there are no restrictions.

You can choose to buy it under your sole name or buy together with your spouse as a matrimonial property and Additional Buyer Stamp Duty will not be applicable.

Hi,

1) Yes, you are perfectly right on the HDB flat is the only housing property that has such restriction.
2) The main reason is because the govt deemed that all HDB flats are heavily subsidized accommodation that should be provided for citizens/residents who just need a roof overhead.
3) Having such restriction will prevent people from speculating the flats for profit.
4) You are also should be aware that any residential property overseas will not trigger any ABSD when buying residential property here.
5) The IRAS will only count residential property in Singapore to determine whether you are subject to ABSD.
6) Once you are married and buy with your spouse, the purchasing of matrimonial home will also be exempted from ABSD.

If you both want to buy an HDB now, HDB will generally require the overseas residential property to be disposed of first. After the legal completion of the sale, you'll typically need to wait 15 months before you're eligible to buy a resale HDB, 30 months if you want to buy a BTO.

For a private property, there's no requirement to dispose of the overseas property first. However, whether ABSD is payable depends on factors such as who is buying the property, the ownership structure (holding manner), and each buyer's residency or citizenship status.
