Hi. I stay in a joint tenancy flat with my parents and sibling. I am funding the flats installments with my cpf. If i decide to get married to a foreigner spouse, what happens to my hdb flat ownership. Does it automatically belong to my spouse too? Or can my spouse make claims on the property/or able to sell it should i pass away suddenly?

Hi,

As your spouse is a foreigner, he/she cannot own a HDB flat. Hence there is no right of claims from him/her. Furthermore, the property is under Joint-Tenancy. Under such arrangements. in the event of death of one party, the property ownership will be passed on to the surviving owners.

Hi,

1) Under joint tenancy, it is the survivor takes all. Meaning the survivor/s will takeover the deceased shares without any challenge.
2) Your spouse cannot be an owner of an HDB flat. And your spouse also will not be able to take over even if you pass on because this is under Joint-Tenancy.
3) In your case, your parents will be the only owners of the flat if there is anything happened to you.
