Good afternoon Sir,

you will have to appeal to HDB with valid reasons and it will be based on a case by case basis.

But I am afraid to share with you that the success rate is not high. Perhaps you can consider to transfer your share to your sister instead so you can purchase a resale HDB with your spouse. If not you will have to opt into the private segment.

1) Yes, you may appeal to the HDB for exemption. But like YT highlighted the chance of success is very low.
