Hi there, for divorce case, you should only be able to start selling your property after you have attained the final judgement, The Final judgement would have already finalize the proportion for the proceeds and any other assets you guys have. its best to engage a private lawyer who will do up the splits accordingly to the final judgement and issue the chqs to the individual parties accordingly after the sales. Engagement of the lawyers would have to be finalize at the submission stages after the HDB is sold.

Have you obtained the final judgement?

If you are using HDB lawyer for conveyancing, they will not do any form of splits for cash proceeds. The appointment is done during the resale application process. For private law firm, you can immediately keep the lawyer in copy once you have already issued the Option to Purchase. They will guide you along the way.

Hi Alvin,

I have personally handled many divorce cases for HDB sale before. Let me try to provide you with some clarifications.

If the flat is held under Tenancy in Common and you are in a amicable relationship with the other party, you can get HDB lawyer to act for you and the cashiers order will be split in your respective share of the property and you both may work together to deduct the costs involved. You will only need to engage the lawyer during the HDB submission after the flat is sold.

If both of you are not on good terms then it is best to engage a private lawyer who will deduct all the costs from the sale and split to sale proceeds according to the court order and pay you your share in a cashiers order.

Standard divorce proceeds from the sale of the matrimonial unit will be payable to the individual accounts, as stated within the Court Order. As for the joint account, it will be included within the settlement of ancillary matter, before the Court Order is out.
