If your husband is currently overseas, you can still proceed with property transactions in Singapore, but specific legal and administrative procedures apply depending on what you are planning to do:
---
### 1. Buying an HDB Resale Flat (SC + SPR Scheme)
* **Eligibility (Public Scheme):** As a Singapore Citizen (SC) and Singapore Permanent Resident (SPR) couple, you form an eligible family nucleus to purchase an HDB resale flat together (co-owners) or with you as the sole owner and your husband as an essential occupier.
* **HDB Flat Eligibility (HFE) Letter:** Both of you must apply via Singpass on the HDB Flat Portal. He can log in to his Singpass remotely from overseas to provide his particulars, income details, and consent.
* **Power of Attorney (POA):** If he will not be back in Singapore to sign the official documents (e.g., Option to Purchase, lease documents, or legal completion), he must execute an **HDB-approved Power of Attorney (POA)**:
* The POA must be prepared by a Singapore law firm.
* He must sign the document overseas in the presence of a **Notary Public** in that country, an official at the **Singapore Embassy / High Commission**, or a Commissioner for Oaths.
* The physical executed document must be sent back to Singapore for court registration before it can be used.
---
### 2. Buying Private Residential Property
* **ABSD Status:** For a married SC + SPR couple purchasing their **first residential property jointly**, you are eligible for the **first-timer SC treatment (0% ABSD)** instead of the 5% SPR rate, provided neither of you owns any other residential property.
* **Overseas Execution:** Private conveyancing law firms can similarly handle overseas document execution via an appointed POA or notarised signing at a local Singapore overseas mission.
---
### 3. If You Are Selling an Existing Property
* If your husband is currently a co-owner of a property you are selling, his signature is mandatory on the Option to Purchase (OTP) and conveyancing deeds. If he is away, he must appoint you or a proxy via a registered POA to sign on his behalf.
---
1. What transaction are you looking to carry out while he is overseas (buying an HDB/private home, or selling an existing flat)?
2. How long will he be overseas, and do you need a conveyancing law firm recommendation to draft an urgent Power of Attorney (POA)?
