I am getting a divorce, no kids.
Currently staying in a 5i HDB, mid to high floor, unblock view, nicely renovated (imo lah haha) and already MOP this year. Never intend to sell till I die actually haha but bo pian. Got first timer grant for this house with HDB loan.
I saw that the recent transacted amount in my neighborhood is about $650-$680 but hoping to sell at $700, split the sale and buy a resale 2/3 room that is relatively new and renovated already, ideally, but am not sure if i can afford though that is worry.. My annual income is about 50-55k.. am 40 years old with no intention of remarrying, so looking for my forever home, hopefully.. Any advice is appreciated, pls. Thanks

Hi, so sorry that you are placed in such an situation. I see that you have already seen the recent transactions for the houses in your area, and since you are going to be selling above that, there might be a case of COV, which will need a good agent to help you justify the selling price. Also, since you are getting a divorce, you will have to wait till the final judgement before the sale of the flat can proceed.

Let me firstly explain what will happen when you sell the house. Firstly, after lets say you sell the house at 700k, it will firstly offset the outstanding loan of the house, followed by the CPF used for the house. The remainder will then be split accordingly based on the ruling of the final judgement, after the deduction of all the costs.

While you are doing the sales of the house, you can actually start applying for an HFE, which will show you the grants you are eligible for, as well as the resale levy applicable, followed by loan amount you can get. Based on the rough amount provided by you, the maximum loan you can get is around $289k. so with all these numbers, we can actually work out a budget and then provide better advice. Of course, if you are willing to discuss this with me, I can provide more insight for you.

Sorry to hear about the situation. For divorce cases, the sale of the property will usually be done after final judgement has been done thus in the event where there is any disagreement, this can be sorted out in court. The key consideration here will be how will the sales proceeds be split that will affect your finances to purchase the next unit when you have sold the current place.

With that settled, then you will be eligible to apply for HFE as a single purchase to know your loan eligibility on top of the funds you have existingly for the purchase to work out what your options are in the resale market.

I am sorry to hear about your situation.

For your situation, you can sell the flat anytime now, since you have already met your MOP. But you will not be able to apply for HFE to purchase your next flat under your sole name if you're planning for a divorce.

You will need to first file for the divorce, and only can apply for HFE after the Final Judgement is out. And when you file for the divorce, the sale of your current flat will also be impacted as such that the sale proceeds will be split in the manner stated in the Final Judgement (instead of selling it while being married).

Selling the flat before or after filing for divorce can be very different. Perhaps we can have a more in-depth discussion on your plans going forward?

It depends on how much hdb loan still outstanding, as that will determine the sale cash proceeds and cpf refund that you will get and can use for the next house.
