Hi I am a pr going through a divorce case with my wife. We have a hdb flat which we are planning to sell once we recd the judgment order (about 4 mths later). However, I just saw a condo which i like and would like to buy it under my name (single ownership). Since I am a pr, 1) how much stamp fees much do I pay for the condo 2) do I get a refund of my ABSD back once I sold the hdb flat (take note I am a pr), if I buy the condo now 3) what other options would be best in order not to incur additional stamp fees.

Dear sir, I would think it is the best to seek IRAS clarification in this instance. The most optimistic scenario will be you get the rebate on the difference of ABSD applicable to PR on the first and second property. I highly doubt that it will happen if you purchase now but that is just my opinion. Good evening, The stamp duties applicable to you will be estimated 3% plus 10% ABSD. I doubt you will be enjoying the ABSD relief as it stated clearly that only married couple with at least 1 SC with a SPR/ foreigner spouse who purchase a residential property are able to enjoy ABSD relief as it will be treated as a matrimonial house. This will not be applicable in your case. Even though its my personal opinion with my accounting background but it will be best to contact IRAS for confirmation. Dear Home Seeker, if you buy now, your stamp duty tax is 13%. IRAS see it as you are PR owning 2nd property. They wont know that u are going thru a divorce and is selling away a home in due course. Hence, to avoid paying higher tax, the best way is to buy AFTER disposing your hdb flat. As soon as the buyer of your hdb flat exercises the Option to Purchase ("OTP"), you are deemed to have 'sold' it and with the exercised OTP you can make another purchase in your sole name with 8% tax. Stamp duty relief / remission is not applicable for singles regardless you are PR, Citizen, Foreigner. The spirit of a stamp duty remission is to benefit the married couple and having said that, it is only for their FIRST matrimonial home and at any one point in time, this married couple can only hold 1 property under their joint names.
