Hi, appreciate your sharing. It depends on court order if required. If it is pure selling with any legal issue, what ever amount you pay using CPF OA (with interest), will be returned to the party.

Hi,

The sale cash proceeds will go directly to you only if you are the sole owner, unless this is a divorce case where the court order rules otherwise. If its joint ownership, the sale cash proceeds will be issued in a joint name cheque. Do note even if your wife is just an occupier, hdb will still need her to endorse the sale to approve the process.

Dear sir/mdm,

For units under joint ownership, the sales proceeds will be disbursed via cashier's order upon completion under joint names, therefore you will require a joint account to deposit the cashier's order. This will be the arrangement if you engage HDB lawyers for conveyancing. If you engage a private lawyer for conveyancing, which is more expensive, you can instruct the lawyer to arrange for the cashier's order to be paid to your name only.

The sale proceeds will usually come in the form of a Cashier's Order in both your names if you have engaged a HDB lawyer to act for you. If you wish to split the proceeds in mutually agreed shares, you may choose to engage a private lawyer to act in the conveyancing instead.
