Hi Guru, I am 35 years old this year. I intend to marry my boyfriend (above 35 years old) who is a foreigner. Before we know each other, he already owns a property overseas. If we marry each other (and assuming that his foreigner status remains status quo), what are the public and private housing options available to us? Will he need to sell away his overseas property? Appreciate your help.

Hi,

I'm assuming you are an SC for the following responses:

1) You are eligible to buy an HDB flat under Single Citizen Scheme if you buy before you are married.
2) You may also buy an HDB flat under the non-citizen spouse scheme if you buy after married.
3) The difference is your bf needs to sell his overseas property under (2).
4) There is no restriction to buy a private residence whether you buy before or after marriage.
5) But the buyer stamp duty will be different.
(a) Buy before marriage, you + your bf will incur additional buyer stamp duty (ABSD) of 30%.
(b) Buy after marriage, you + your spouse will not incur any ABSD because this will be classified as your matrimonial home.

Hi Mdm,

You can purchase a private property with your name alone or together with him (without the need to pay ABSD) because it will be considered as your matrimonial property. However, if you were to purchase a HDB under the non-citizen spouse scheme, your boyfriend will become the essential occupier of the house and he will need to sell off his overseas property.

Hi Ms,

If you are a Singapore Citizen, you can purchase the HDB flat before you get married under Single Scheme. He can keep his overseas property after you get married.

If you purchase the HDB flat after you get married, it will be under "Non-Citizen Spouse Scheme", and you will need to include your husband as an essential occupier of the flat. This means that he will have to dispose off his interest in all private properties (local and overseas) latest within 6 months upon the HDB flat purchase.

If you choose to purchase a HDB resale after getting married, you will need to purchase under non-citizen spouse scheme. Under this scheme, only you will be named as the owner while your spouse will be an occupier since HDB does not allow a foreigner (except for SPR) to be named as an owner. In addition, your spouse would need to disposed off his overseas property within 6 months after you have purchased the HDB as he is deemed to be an essential occupier. To avoid such complications, it is advisable if you purchased a HDB as a singles before getting married. You will be able to enjoy singles grant and your spouse won't be required to dispose off his overseas property even after getting married to you. If you choose to purchase a private property, you may do so just like any other Singaporean couples. Your spouse will be able to be a joint owner and ABSD will be remitted (matrimonial house IRAS apply exemption on SC/FR couple) which means there will not be any additional buyer stamp duty incurred.
