Hi good afternoon.. I’m Indonesian PR. My husband and my children’s is SC I have 4 children’s total with me. The eldest is going to 17 years old this year. And he studye in polytechnic. Currently i have matrimonial property with my husband bought in 2020. With $30k grant staying nearby with husband parent’s home. This is our 2nd home. 1st home is BTO flat we selling after 5years MOP. My question is.. if we divorce, what happen to this house? Can i buy new flat such as BTO or resale flat right after we sell this matrimonial house?

Good afternoon Mdm,

you can state the outcome of current flat on the court order/ final judgment (divorce papers) like sell the house etc.

With the final judgement then you can appeal to HDB branch officer to seek special approval to sell the place as its still within MOP. One way is to sell your share to him as he's able to own a HDB as a single SC.

While for you, you can take over existing unit or buy a HDB only if with your son as you are unable to own a HDB as a single SPR.

There will be a final judgment court order when the divorce proceedings conclude, we can use that to appeal with the hdb branch officer to sell within MOP period, either your part share to your spouse (he can keep as SC if custody of children granted to him), or to sell in open market as resale. Such approval is on case by case basis but typically divorce cases do have a better chance. However you as single SPR can't keep the hdb on your own.

Hi,

1) This matrimonial home is a common asset in your marriage. Therefore you have to discuss with your husband how to split it between yourself.
2) If you can have a common agreement between yourself then it will be easier. Otherwise, yours and his lawyer will have to bring this up to court for judgment based on the contribution from each party. The contribution is not limited to monetary contribution.
3) Your share can be bought over by your husband and vice versa. Otherwise, this will be sold in the open market and split the sale proceeds according to the final court order.
4) You are eligible to buy resale & BTO if you own the legal care and custody of your children under the public scheme. You will have to get your ex-spouse written agreement before you can list your children in a BTO application. This is not applicable to resale flats.
